Significant representative engagements handled by the energy litigation team include:
- Represented several interstate natural gas pipelines, in the massive Calpine bankruptcy, filed in the Southern District of New York, on breach of contract claims with hundreds of millions of dollars in dispute
- Represented an interstate pipeline in a two-week arbitration hearing in Oregon involving multi-million dollar claims associated with defective software development.
- Defended pipeline against claims by a power plant regarding gas quality and damage to turbomachinery. Settled matter on “eve” of trial for between 1-2 percent of original damages claimed
- Represented pipeline in multi-million-dollar claim over construction delays
- Prepared for month-long arbitration hearing regarding multi-million-dollar claims over defective gas turbines, with case settling on the “eve” of the hearing
- Represented pipeline in claims against major electrical generator in breach of contract claims that raised issues of first impression under the Canadian toll structure
- Prepared for two-week arbitration hearing relating to competing claims for construction disputes in a delivery station, obtaining $1.6 million award for client against contractor
- Defended interstate pipeline in odorization dispute in which over $2 million in damages were claimed. Obtained complete summary judgment for client
- Defended developer of Maine wind farm in New York lawsuit against multi-million-dollar claims for breach of contract, obtaining complete summary judgment for client
- Prosecuted claims for easement contamination against pipeline
- Represented oil and gas developer against international bank in North Dakota trade secret dispute, trying case to judgment and handling appeal.
- Represented drilling contractor in disputes over millions of dollars in contract claims.
